13 facts one should know about Gratuity Act in India!!




Some Basics about Gratuity:

  • Gratuity Act is applicable to all establishments, where number of employees, are 10 or more in any day of the preceding 12 months.  Click here to download the Gratuity bare act.
  • Charitable institutes and hospital are also covered under the act.
  • It includes both commercial and non commercial establishment like educational institutes etc.
  • Only Basic and Dearness allowance should be considered as wages for the purpose of Gratuity.
  • Gratuity payment formula:

Example: If an employee leave company after 10 years and his last Basic + Dearness allowance is 10000 then his gratuity will be paid as per following formula.

(10000/26)*15* 10

Please note that above formula will remain same irrespective of employee working in 5 days a week establishment.


FAQ  1: Can an employee claim Gratuity even before completion of 5 years?

Yes, An employee can claim gratuity even before completion of 5 years in followings cases:
  • Death (to his nominees)
  • Disablement

But the quantum of gratuity will be as per act.

FAQ  2: Can employer forfeit Gratuity, even if employee has completed 5 years?

Yes, employer can forfeit gratuity even if employee has completed 5 years in following cases:

  • If the services of such employee have been terminated for his riotous or disorderly conduct or any other act of violence on his part, or
  • If the service of such employee have been terminated for any act which constitutes an offense involving moral turpitude, provided that such offense is committed by him in the course of his employment.


Please note that above act should have been committed by employee during his employment. There should be a proper enquiry held after which employee was found guilty for aforesaid act or misconduct. Once proved guilty, employer should issue termination note to employee describing about his misconduct.

FAQ  3: Gratuity Payment when employee has completed 4 year and 240 days in 5th year?

This is one the most frequently asked question and there are various views available on it.

As per Section 2A of Gratuity Act (Continuous Service), an employee is eligible for gratuity if he has completed:

(i) one hundred and ninety days, in the case of an employee employed below the ground in a mine or in an establishment which works for less than six days in a week; and


(ii) two hundred and forty days, in any other case;

Earlier, I was also of opinion that gratuity can only be paid once an employee completes 5 years of continuous service which is not the case now as state above.


Following is the complete draft of the Section 2A of Gratuity Act for better understanding:

Section: 2A
Continuous service.

For the purposes of this Act, -
(1) an employee shall be said to be in continuous service for a period if he has, for that period, been in uninterrupted service, including service which may be interrupted on account of sickness, accident, leave, absence from duty without leave (not being absence in respect of which an order [***] treating the absence as break in service has been passed in accordance with the standing order, rules or regulations governing the employees of the establishment), lay off, strike or a lock-out or cessation of work not due to any fault of the employee, whether such uninterrupted or interrupted service was rendered before or after the commencement of this Act.
(2) where an employee (not being an employee employed in a seasonal establishment) is not in continuous service within the meaning of clause (1), for any period of one year or six months, he shall be deemed to be in continuous service under the employer -
(a) for the said period of one year, if the employee during the period of twelve calendar months preceding the date with reference to which calculation is to be made, has actually worked under the employer for not less than -
(i) one hundred and ninety days, in the case of an employee employed below the ground in a mine or in an establishment which works for less than six days in a week; and
(ii) two hundred and forty days, in any other case;
(b) for the said period of six months, if the employee during the period of six calendar months preceding the date with reference to which the calculation is to be made, has actually worked under the employer for not less than -
(i) ninety-five days, in the case of an employee employed below the ground in a mine or in an establishment which works for less than six days in a week; and
(ii) one hundred and twenty days, in any other case;
Explanation: For the purpose of clause (2), the number of days on which an employee has actually worked under an employer shall include the days on which -
(i) he has been laid-off under an agreement or as permitted by standing orders made under the Industrial Employment (Standing Orders) Act, 1946 (20 of 1946), or under the Industrial Disputes Act, 1947 (14 of 1947), or under any other law applicab1c to the establishment;
(ii) he has been on leave with full wages, earned in the previous year;
(iii) he has been absent due to temporary disablement caused by accident arising out of and in the course of his employment and
(iv) in the case of a female, she has been on maternity leave; so, however, that the total period of such maternity leave does not exceed twelve weeks.
(3) where an employee employed in a seasonal establishment, is not in continuous service within the meaning of clause (1), for any period of one year or six months, he shall be deemed to be in continuous service under the employer for such period if he has actually worked for not less than seventy-five per cent of the number of days on which the establishment was in operation during such period.

FAQ  4: Gratuity payment in case employee has worked for more than 5 years with same employer but in different establishment?

Let’s take an example, that if an employee has worked in a company ABC for 3 years and due to some reason, he has been moved to company XYZ under same management. Employee got his Full and Final from ABC Company but not the gratuity amount as he has not completed 5 years there. He has spend another 2.5 years in company XYZ and resigned. At the time of his Full and final, will he be eligible for gratuity?

Answer is yes as both the companies are under same management and employee has completed 5.5 years to gather in both companies.

FAQ  5: Do company need to take insurance policy against LIC? Is it mandatory?

Gratuity payment is responsibility of employer. Nowhere in act, it is mentioned that employer need to take any sort of insurance policy for gratuity payment. Hence it is up to employer whether they want to take insurance policy to cover its gratuity liability.

There are various benefits of taking insurance policy for insurance company to cover gratuity liability, let’s say LIC:
  • Employer ensure that its liability is taken care by giving regular premium to LIC
  • Employer get tax rebate against that payment.
  • LIC also do life insurance for each employee hence in case of employee’s death, employee family get sum insured amount apart from gratuity.


FAQ  6: How much gratuity amount is exempted from income tax?

FAQ  7: Can a company refuse to pay gratuity due to financial Loss to employees?

No, even if company is not doing financial well, company is bound to pay gratuity amount.

Company should ensure that it pays gratuity within 30 days from the date when gratuity become payable to an employee. Also it is responsibility of employer to notify employee about his gratuity payment even if employee do not apply for same. It is employer duty to pay the gratuity.

FAQ  8: Will an employee resigning from service or retrenched by employer will be eligible for Gratuity?

Yes, if they are satisfying the criteria of completion of 5 years. In case of employee who has been retrenched after 5 years of continuous service will get both gratuity and retrenchment benefits.

FAQ  9: Gratuity in case of contractual employee. Who will be responsible to pay gratuity?

In case of contractual employee, contractor is liable to pay gratuity but if contractor do not pay gratuity to employee then principal employer can be directed to pay the gratuity amount.

FAQ  10: Will trainee be entitled for Gratuity after completion of 5 years?

Yes. But employees who are hired for some temporary work should not be considered under gratuity act. Please download some important judgement in support of this.

FAQ  11: Company making gratuity as part of CTC is correct?

This is another most debatable topic. Basically CTC stands for, cost to company and every company takes it different way. Hence, it is up to company whether they want to make it part of employee CTC or not.

There are two views:

One, employee become eligible for gratuity only after completion of 5 years so how come company can make it part of employee CTC and what if employee do not complete 5 years and leave the company before.

Second, as it is liability of employer to pay gratuity to employee in two cases: 1) when employee competes 5 years and 2) in case of death and disablement irrespective of completion of 5 years hence employee should make it part of CTC especially when employer has taken insurance policy to cover gratuity liability.


FAQ  12: What is the ceiling of gratuity amount payment?

It is Rs 10 L. In case an employee gratuity amount is more than 10 L then company is bound to pay max 10 L. In case company want to pay more than 10 L then company can pay it as performance bonus or ex gratia. Click here to download the notification for same.

FAQ  13: How to treat number of months for the purpose of gratuity calculation after completion of 5 years?

For example, if an employee has worked for 5 years and 7 months then for the purpose of gratuity payment, 7 months will be rounded off to an year and he will get gratuity for 6 years but in case employee has worked for 5 years and 5 months then he will be eligible for 5 years gratuity payment only.

Dear Govind,

It will be 8th Month since I resigned from a news channel. Completed 6yrs 7month dedicatedly honestly. But when I ask for my gratuity no one from accounts and HR Seniors are replying to my Phone Calls, SMS, E-Mails. Its a Shame how can one communicate in such situation. Although I explained them I urgently need gratuity money for my mother father treatment. But no one is responding. Its so frustrating. What if I take a wrong step and teach them a lesson. Reality is very different Govind from your this theoretical guidance.In Practical HR Department and Accounts are very cunning.
Please explain me one thing - When Head HR is not picking my phone calls/ replying to mails and sms, simply ignoring me and my 6yrs 7mnths honesty, Then how can one expect justice. Why a employee has to struggle? You are in same fraternity, may be your point of view is same. By Posting query will I get my money on time when needed or I have to wait till some bad news from home.

Question is why HR and Accounts change themselves once employee resigned or terminated and treat them as garbage.

i have a query. if a worker leaves without one month notice and company does his settlement by giving him his particular month salary and 1 month salary extra with letter and he signs agreeing to it. later on after 10-15 days he claims that he is liable for more.
so in this case is the company liable to pay gratuity ?

Hello Mr. Negi,

I have resigned from a company after giving notice period. I worked their April 07 2008 to 12 Sep 2014. In between there was no gap. They have calculated gratuity for 3.25 years only and even they hold the gratuity payment as they are waiting payment from LIC. Normally in how many days LIC will pay the money to Employer? is above calculation correct? 3.25 yrs.

after scrolling through many sites in dire need for answers yours is our only hope,we are honest employers of 6 people since 2007 who we were paying high salary regularly for labour class but they resigned toghether leaving us in dire state to start their own thing.following are the question i want to ask as they have asked for gratuity.

Hi,

There is a query pertaining to section 4A of Gratuity Act, 1972. It is clearly mentioned and explained that the Insurance is compulsory for all kinds of establishments.

Is it really mandatory. There are companies which are bearing gratuity costs on its own without taking a LIC policy.

How does a company benefit from LIC. One benefit I known is in case of paying income tax. Are there any other benefits.

Hi...Thanks for good insite... I had worked for a comapny for 4 yrs and then one division was aquired by other company promising a continuity of service and They had also issued a gratuity letter to me that they will pay the gratuity if you complete the 5 yrs combining both my previous exp and exp in this company. Now they are not giving me the gratuity saying you had not completed 5 yrs here. So my question is whether continuity of service is applicable in my case of partial acquisation. whether I am eligible for gratuity or not. when I resigned I had completed more then 5 yrs combined in both company.

Please help. I worked for my company for 5 years, due to some personal issue after my maternity, I resigned from my job (without serving notice period) however got the relieving letter from company after discussion with HR.

Now, HR is saying that you have a recovery(100000) to pay and that is why we can't process your Gratuity.

i am working in a ltd company for last 10 years they have introduced c t c and issued appointment letter in which they have mentioned that GRATUITY will not be paid .can a company deny payment of gratuity to its employees since this is a govt of INDIA gazetted notification .since we cannot protest due to termination and loss of job ,we seek to know legal recourse available .

I worked 3.2 Yrs for my previous company (big telecom vendor) in a specific project, but they quit the project and asked all employees of that project to resign. Am I (many of us) eligible to get Gratuity, those who completed 5 Yrs today received their Gratuity (after 3 months) but we didn't .

Dear Sir if, one employee working with same company same position last 20 years and company publish the advertisement one hire post that employee clear the interview and offer the hire post, but company condition 1st resign from current post and then join new post. Employee resigns from current position and join on new post, then company eligible for gratuity payment or company pay gratuity after his retirement. can company pay two time gratuity same employee.

But I feel it is not possible that you can not produce any such document.

When you leave the organization you can certainly claim for gratuity.

hi...Thanks for valuable info. I want to know that can a employer put a condition on employees that if they resign even after completion of 5 years, they will not be entitled for Gratuity unless employer himself terminate them. And, will your answer be the same in case of an autonomous body/societies of Centre govt.

Second question, I am working for an autonomous body/Society of Centre Govt. but not on the payroll of the autonomous body i am work for. I am on annual contractual basis, officially on the payroll of a contractor not on the department I work for. Every two year or so, new tender floats and contractor changes, but we guys are not fired or re - hired. We keep working in the department as usual, sharing the seat with the regular staff as well (sitting arrangement at dept.site). It does not affect us the changing of the contractor, who is officially our employer. Now if a person on contractor payroll, resign after completion of 5 years (probably not one contractor for entire five years), but serve the same department for the same period will be eligible for Gratuity. If yes then whom to claim, current contractor, or dept. one work for?

Third question, what is the definition of 'Principal Employer'?

Please provide your valuable thoughts.

What I understood is as like insurance employer suppose to opt and pay from CTC to gratuity. But our employer not doing. Is this true and possible ?

When we talk about CTC, it is not deduction from employee salary but contribution made by employer. Hence your assumption that company is deducting anything from your salary is not correct.

If an employee leaves the company on or before 5 years then employee will not get gratuity even if it is part of employee's CTC.

If you have worked with an organization more than 5 years (7 years in your case), then you are definitely eligible for gratuity.

You should write a letter to your company asking for Gratuity and send this through registered post with AD.

My Brother died in a road traffic accident on 15 Mar 15 while working in SKS Microfinance Ltd as a field assistant. It has been already 5months past since we submitted all the documents to the company's HR Department for his last settlement like gratuity, pf and insurance etc. But recently we got gratuity only. Not sure if the thread is active as I didn't see any recent post here. But would like to post my query here.
I started with a firm in India in Jan 2010 and worked in India for the same firm till Oct 2013 (close to 3 & half yrs).
Then same company has moved me to US office for another assignment and hence I got switched to US payroll in Oct 2013. I continued to work there till Oct 2015 and resigned in US itself.
Overall I worked for the same company for close to 5 & half yrs (3 & half yrs on India payroll and 2 yrs on US payroll)
Am i eligible for gratuity?

ESI Pension (If he is under ESI)

I have a query - In the present context of New Pension Scheme (Contributory Pension Scheme), Government/semi & Quasi Govt establishments, private companies deny Gratuity to its employees who retire on superannuation. Govt of Tamilnadu appointed Teachers on their virtual seniority in the Employment exchange since 2004, who had less than 10 years of service. Can the Govt deny Gratuity on the pretex that the employee is a subscriber to Contributory Pension Scheme. Is there any Rule/Act in CPS say that the New Pension Scheme subscriber is not eligible for gratuity. Is there any protection in Gratuity Act or New Pension Scheme for provision of Gratuity to employees who had served as Government employee for less than 10 years on retirement. Please clarify me

A Teacher in Tamilnadu Government joined service in Sep 2006 as government employee on Employment seniority. Govt of Tamil Nadu provided permanent jobs to Teachers even though they have less than 10 years service for retirement. She retired on 31.12.2015. All employees appointed after 01.4.2004 are compelled to opt NEW Pension Scheme (CPS). Govt now says you are covered under New Pension Scheme. Therefore Old Pension Rules are not applicable to you. Hence, No Gratuity will be paid. Why do they link New Pension Scheme with Gratuity Act ? As far as I am aware, no such prescribe Rule or clause exists in CPS nor the present Gratuity Act was either repealed or deleted or cancelled or any amendment has been issued ever since. Please guide.

My last company told me to leave in 2014 december. The reason was not clear. My manager said that your performance in the team is terrific but the CEO has asked to leave as u are not progressing if experience is concerned. Also they have never notified me that i ll be asked to leave. That time I was performing really well in my current project and was appreciated.

But they thrown me out as I was going to complete 5th years in 1 more year and then the sum of gratuity was involved. Can I file a case against him?
Also if performance was the reason why did not they fire me in the earlier years.

After working in another company for about a couple of years, I was called back by the same old company and I joined there and still working there. But for the second term, I was recruited as a new employee and I withdrew my PF money also. Now, when I am asking for my gratuity for the first term, my employer says I am still working there and so they cannot pay it. Is it true that I am not eligible for gratuity? CTC is something which we negotiate and it's part of our cost so companies should pay it back.

If companies are paying from there pocket then it's a separate part

after going thoroughly of the above posts, i have not fond a solution of a new type of problem. So please help and advise. The Case is " A person joined in a company in the year 2000 and discharged his duty without any fail. In the year 2013 he has attained the age of 60 years. Then on his personal request his service was extended for another 02(Two) years i.e up to 2015 December. Again his service was extended for another 1(One) year ie up to 31.12.2016."

I had joined a PSU bank on 26th march 2012 and date of leaving would be around 23rd dec 2015. So, i am staying in service for 4 yrs and 9 months. I have read in this blog that if we have worked for 4yrs and 240days, we are eligible for gratuity. So, am i eligible since i will be completing 4 yrs and 240 days ??

What will happen in case an employee completed more than 4.5 years of service in a company and suddenly the company gets shut of due to financial or any other reason. In such case can the employee entitled for gratuity?

I worked for a 20 yr old company for two years in the senior management but they decided to shut shop coz the company s performance was going down. Am I eligible to ask for gratuity. They have given two months notice period as per the contract.

I have joined ICICI home finance company as on 15th Nov 2007 as Executive 1(Permanent Basis) till dated 6th Feb 2011 then I converted in ICICI bank Payroll as officer on dated 7th Feb 2011 till dated 10th Jan 2015.(merger done that icici hfc into icici bank)

What happen if the employer transferred its employees from one company to another for the purpose of saving gratuaity amount. Also pls. let me know that how could one claim for gratuaity if the number of employees are not more then 10 or 12 in last 12 months as the employer keep them transferred from one company to another.

Is there is any rule that the employees joined after 2005 & continuous his services more then 10 years then the calculation was made by 20 days / year. For example
basic salary drawn/26*(years x 20)

My Company is under Audit. We are not as a practice collecting Form I from retiring employees eligible for Gratuity. However we are making the Gratuity payment within the 30 days period.

Auditors are asking for Form I. My question is whether Form I is responsibility of the Employer and in case employee does not submit Form I , can employer deny to pay the gratuity ?

I am from delhi i just want confirm about gratuity rules.
my father is working for a pvt export firm for last 8 years . and he is now about 50 (age). and he has confusion that his employer will give gratuity or not , the company has more than 10 employees even but my father afraid about that he will stop his gratuity if he can .. my father is a very innocent he afraids to claim about gratuity . he says that its on employer if he wants to give it then only we can get gratutity. so plzz let us know if my father give resignation after 1 year we can claim gratuity or not ..or we can get it or not ..

My employer is go to retrenching me this month.

I have been with this employer since 2008.

The total employees strength in India is less than 10.

Am I entitled for gratuity?

I would be completing 5 years of continuous service this July in a media organisation, However, I was informed that only those who have completed 10 years can claim gratuity? Is the employer entitled to do this or am I eligible to claim gratuity after 5 years?

I served in one NGO Trust Hospital for 6 years 1 month and my salary details are as under:

Basic Pay : Rs. 8,966.40 HRA 3,586.56 Special Pay: 8,787.07 Allowance 2,000.00 23,340.03

Against submission of repeated request in writing, personal requests, at last I was called for submission of "No Due Declaration" towards Gratuity of Rs. 31,036/- Myself being a layman, humbly request your kind advice.

Hai, I am ramesh worked sole proprietorship com. Means import and trading com. From last eight years. Now they terminated me. This com. Having only one employee that is me only. I only worker in that com. There is no epf and esi, so now I asking service settlement for my eight years service. They told I don't have 10 more worker people,in my com. so not applicable gratuity act to settled u. So, we didn't do pay anything to u. So now I have to rights to ask service settlement according to any act?pls reply me and help me get settlement way
